These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Oracle Algo ("Oracle Algo", "we", "us", "our") governing your access to and use of our website (the "Site"), our trading indicator(s)/algorithm(s) and related tools (the "Product"), and any associated content, subscriptions, or services (collectively, the "Services").
By accessing the Site, purchasing a subscription, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
1. Eligibility
- You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Services.
- You represent that you have the legal capacity to enter into a binding agreement and that your use of the Services complies with all laws applicable to you, including in your country or state of residence.
- The Services are not directed at, and must not be used by, residents of jurisdictions where their use would be prohibited or unlawful.
2. Description of the Service
Oracle Algo provides access to a proprietary trading indicator/algorithm designed to be used on third-party charting platforms (e.g., TradingView or similar). The Product is a technical/educational tool that generates signals, alerts, or visual overlays based on market data.
Oracle Algo is not a broker, exchange, investment adviser, portfolio manager, or financial institution. We do not execute trades, hold funds, manage accounts, or have access to your brokerage or exchange accounts.
3. No Financial Advice — Risk Disclosure
- Nothing provided through the Services constitutes financial, investment, trading, tax, or legal advice. All content, signals, indicators, and materials are provided for informational and educational purposes only.
- Trading and investing in financial markets (including but not limited to stocks, cryptocurrencies, forex, futures, and derivatives) involves substantial risk of loss and is not suitable for every individual. You may lose some or all of your invested capital.
- Past performance is not indicative of future results. Any performance figures, backtests, or hypothetical results presented are not a guarantee, promise, or reliable indicator of future performance and are inherently limited (backtested/hypothetical results do not represent actual trading and do not account for certain market factors, including liquidity and slippage).
- You are solely responsible for your own trading and investment decisions. Before making any financial decision, you should conduct your own research and, where appropriate, consult a licensed financial advisor.
- Oracle Algo makes no representation or warranty as to the accuracy, completeness, timeliness, or reliability of any signal, alert, or piece of data generated by the Product.
4. Subscriptions, Fees, and Payments
- Access to the Product is provided on a subscription and/or one-time purchase basis, as described on the Site at the time of purchase.
- All payments are collected and processed through Whop, a third-party platform. By making a purchase, you also agree to Whop's own terms of service and privacy policy, which govern the payment processing itself. Oracle Algo does not directly store or process your full payment card or wallet details.
- Prices are subject to change at any time; changes will not affect subscriptions already in progress until their next renewal, unless otherwise stated.
- Recurring subscriptions renew automatically at the end of each billing cycle unless cancelled beforehand through your Whop account/dashboard.
- Refunds, where applicable, are handled in accordance with our refund policy [insert refund policy or link] and are subject to Whop's processing capabilities. Except where required by applicable law, fees already paid are non-refundable once access to the Product has been granted.
5. Access, License, and Restrictions
- Subject to your compliance with these Terms and payment of applicable fees, Oracle Algo grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Product for your own personal, non-commercial use.
- You may not, and agree not to:
- copy, resell, sublicense, rent, lease, or redistribute the Product, its source code, or any related materials;
- reverse-engineer, decompile, or attempt to extract the underlying logic of the algorithm/indicator;
- share your account, license key, or access credentials with any third party;
- use the Product or Services for any unlawful purpose, or in a manner that infringes the rights of Oracle Algo or any third party;
- use automated means (bots, scrapers) to access the Services except where expressly permitted.
- Oracle Algo reserves the right to suspend or terminate your access, without refund, in the event of a breach of this Section.
6. Affiliate Program
If you participate in the Oracle Algo Affiliate Program, your participation is additionally governed by the separate Affiliate Program Policy, including its strict prohibition on brand bidding. In case of conflict between these Terms and the Affiliate Program Policy on affiliate-specific matters, the Affiliate Program Policy shall prevail.
7. Intellectual Property
All content, trademarks, logos, source code, algorithms, designs, and materials made available through the Site and the Product are the exclusive property of Oracle Algo or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you.
8. Third-Party Platforms
The Product may be designed to operate on or in connection with third-party platforms (e.g., charting or brokerage platforms). Oracle Algo is not responsible for the availability, performance, security, or terms of any third-party platform, including Whop, and your use of such platforms is governed by their own respective terms.
9. Disclaimers
THE SERVICES AND THE PRODUCT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. ORACLE ALGO DOES NOT WARRANT THAT THE PRODUCT WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SIGNAL WILL RESULT IN A PROFITABLE OUTCOME.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ORACLE ALGO, ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR TRADING LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICES OR PRODUCT, EVEN IF ORACLE ALGO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, ORACLE ALGO'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO ORACLE ALGO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Oracle Algo, its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your trading activity, or your violation of these Terms.
12. Termination
Oracle Algo may suspend or terminate your access to the Services at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to Oracle Algo, other users, or third parties. You may cancel your subscription at any time through your Whop account; cancellation will take effect at the end of the current billing period.
13. Changes to the Services and These Terms
Oracle Algo reserves the right to modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms from time to time; the "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction to be inserted], without regard to its conflict of law principles.
